Agreement for Sale of Biewer Terrier

I. Introduction

This agreement is made and entered into this _______(date) by and between Buyer and Seller, for purpose of setting forth the terms and conditions of the purchase by Buyer of one Biewer Terrier dog from the litter whelped on ______ (Date-of-Birth), a ___(Sex-of-Puppy), currently known as _________(name).  This dog is hereinafter referred to as “Puppy.”

The intent of this contract is to protect the lifetime welfare of the dogs.

II. Agreement to Sell and Buy

For the sum of $           (United States Dollars) Seller agrees to sell and Buyer agrees to buy Puppy.

III.  Form and Timing of Payments

1. Ownership of the puppy will be transferred to the Buyer for the sale price of $_______ to be paid        by      ________(date).
2. A 50% deposit is required to hold the Puppy. The puppy will only be held until 16 weeks of age          unless prior arrangements are made to hold longer.
3. The balance to be received by Seller prior to the Buyer taking possession of Puppy.

IV. Failure to Pay
If the balance is not paid by _________ (date), the sale of Puppy will be void, and deposits paid will be forfeited.

V. Transportation of Animals

Transportation shall be agreed upon between Seller and Buyer. Buyer will be responsible for all transportation fees and costs.

VI.  Health of the Animals

Puppy  is being sold as both a companion/pet, and is not to be bred, unless prior arraingments have been made. Puppy shall be registered with the BTRA - Biewer Terrier Registry of America- upon request.  It shall be understood that at the time of sale Puppy  is too young to evaluate for final adult size, but is representative of the German Biewer breed and is structurally and temperamentally sound and is suited as a companion/pet.  There is no guarantee as to show quality.  Seller guarantees that Puppy is free of hereditary defects to the best of his knowledge at the time that Buyer assumes ownership. Puppies are patella checked and there is no guarantee after the puppy leaves the Seller's possession. Sale is contingent on Veterinary Approval within 7 Days after Puppy leaves Seller premises.

Seller guarantees that Puppy  is in good health and has received appropriate medical inoculations, and care.  A health certificate from a veterinarian will be provided to Buyer as soon as possible which will indicate the following:

1. That Puppy is healthy,
2. The number, date and type of inoculations,
3. Rabies vaccinations are not given or recommended until Puppy reaches 8 months of age.
4. The nature and dates of any remaining “puppy” shots that are needed.
  If Puppy has received all recommended vaccines and Buyer gives Puppy any additional vaccines          before its yearly booster is due then this contract is null and void.
VII.  Agency and Broker Restriction

Buyer agrees that she is not acting as an agent or broker in the purchase of Puppy.

VIII.  Restriction on Providing Puppy or Puppy ’s Progeny to Others:

Buyer will not sell Puppy, to any agent, broker, pet store, puppy mill, watch dog facility, or guard dog business.

Buyer understands that Puppy is being sold as a pet only, and that any progeny of Puppy  will not be able to be registered as purebred, pedigreed Biewer Terriers with any registry (other than BTRA or ARBA - American Rare Breed Association) located in Germany, Canada, the United States or elsewhere.

Buyer understands that Puppy will be spayed or neutered at six months of age.  Failure to provide evidence of spaying or neutering before the Puppy reaches one year of age will result in additional monies to be owed to seller in the amount $2000.00.

IX.  Relinquishment of Ownership

Should at any point in the future Buyer be unable or unwilling to continue to care for Puppy, Seller will be given the option to purchase Puppy  from Buyer, at a price to be determined at that time. This is to occur before consideration of any other options regarding the ownership of Puppy.  All cost incurred for the shipment of Puppy will be the responsibility of Buyer. 

X. Future Residence and Living Conditions of Puppy
Seller  agrees that Puppy will:

1. Reside at the home of Buyer,
2. Have access to a fenced yard,
3. Will not be chained nor tethered,
4. Will not be caged, *
5. Will be provided with proper housing,
6. Will be provided with proper diet,
7. Will be provided with proper grooming,
8. Will be provided with proper exercise,
9. Will be provided with proper medical care,
10.Will be provided with annual inoculations, according to AVMA guidelines,
11.Will be regularly inspected and treated for fleas, ticks, and other parasites,
12.Will be spayed or neutered by the time Puppy is six months of age.

*NOTE:  As used here “caged” refers to the practice of forcing a dog to live most of its life in a cage.  This does not refer to the practice of putting a dog into a crate for transportation, sleeping, or humane training purposes. 

XI.  Required Future Notifications

Buyer will keep Seller informed of significant health, temperament or behavior problems encountered throughout the dog’s life.  Buyer will provide pictures and updates of dog’s progress as reasonably requested by Seller.  Buyer will notify Seller in writing of an address change or telephone number or E-mail change within two (2) weeks of such a change.

To the best of his/her ability and knowledge, Seller will keep Buyer informed of significant hereditary health problems encountered in other dogs whelped from the same lines as Puppy.

This contract is governed by the laws of the state of California and is deemed to be executed and entered into in the State of California. Any dispute arising between the parties hereto concerning the meaning or interpretation of this agreement, or the rights, duties, or obligations of the parties to this agreement shall be submitted to and determined in Los Angeles, California.
